Trading Terms for 1st Caravan Hire.

 

       1         The Customer

  (a)      The customer must be over the age of twenty five (25) and if towing, held a full driving license for a minimum of five (5) years, with a maximum of three (3) endorsements of a non serious nature. (Endorsements for minor speeding offences are accepted).

(b)     The customer must be the person in whose name the towing vehicle is registered, unless otherwise agreed.

2         Deposit and Payments

(a)      The customer shall pay a deposit of £150 immediately upon making a booking. The balance of the hire charge is payable at least 30 days before the start of the hire period. (The deposit is refunded 14 to 21 days after the hire period has ended on condition that there is no damage to the caravan and / or its equipment, and that the caravan was returned complete, on time, and in a good and clean condition, otherwise costs will be deducted from that deposit).

(b) A list of costs / charges for cleaning, breakages and damage etc will be displayed inside the caravan. Example: £50 for not emptying the toilet.

(c) The customer authorizes the company to be able to withdraw from the customer’s bank or credit card account, any money owed to the company.

3         Customers Towing Vehicle.

(a)      The customers towing vehicle must be in a good condition, insured, and have a valid MOT certificate during the period of hire. The vehicle must be fitted with a 50mm tow ball (which has  at least 6.5mm clearance), and standard 7 or 13 pin trailer electrics. The customer should make sure that the towing vehicle is suitable to tow the desired caravan by checking the towing vehicles maximum towing weight against the caravans laden weight (as shown on the caravans specifications).

4         Foreign Travel

(a)      If the caravan is being taken out of the UK or to Ireland, you must produce documentary evidence that you have an Emergency Breakdown Assistance Policy (which includes recovery of the car and caravan to the UK). (Available from the Camping and Caravanning Club, the Caravan Club, AA, and RAC, etc)

5         Customers liability

(a)      The customer is fully responsible for the caravan and its equipment from the start of the hire period to the time it is returned to the company, and must inform the company immediately if there is any damage caused to the caravan or its equipment, or if there is any reason for a delay in the caravan to be returned to the company. In the case of a road traffic accident where damage is caused to the caravan, the customer is responsible for paying the first £500 unless they have paid a Collision Damage Waiver, when they are responsible for no more than the deposit they have paid.

(b)     The customer must be aware that the maximum speed limit for towing a caravan is 60 miles per hour.

(c)      The customer must fix a wheel clamp and hitch lock (supplied with the caravan) to the caravan whenever it is left unattended.

(d)     The customer must pay all costs for any damage or losses to the caravan and / or its equipment, not caused by a traffic accident.

(e)      The customer will not lend, hire or create a lien on the caravan for any reason whatsoever, nor carry bicycles or Surf Boards, or smoke in the caravan. Taking the caravan abroad is forbidden unless a director of the company has given written permission (extra deposits / charges / fees may be required).

7         Collection of Caravan

a.       The customer must produce all the original following documents at the time of collecting the caravan. (1) Certificate of Insurance, (2) MOT certificate for the towing vehicle, (3) Driving License, (4) Utility bill from the property of their home address.

b.       The customer must arrange to have an oblong Rear Number Plate made with the same registration number of the towing vehicle, which will be fitted to the rear of the caravan at the start of the hire period. (These can be obtained from such places as Halfords or on the Internet).

c.       The customers photograph will be taken on collection of the caravan.

8         Cancellations

a.       The customer may cancel a booking for caravan hire and have a full refund (less an administration fee of £50) up to 30 days before the start of the agreed hire period, after which a refund is only available if the company manage to re-hire. 

b.    Cancellation of optional extras are not accepted within 30 days of the hire period.

9         The hire Period

a.       The hire period will start on or after 09.30hrs and finish on or before 15.30hrs the agreed dates for hire, as confirmed in writing.

b.       If the caravan is not returned to the company by the end of the agreed hire period (as in 9a) the company will charge the customer an overdue hire charge of £10 per hour until midnight on the last day of hire, then £20 per hour thereon, until the caravan is returned to the company.

10      The company.

a.       The company will make every effort to have the caravan the customer has booked available at the start of the hire period but makes no guarantee to its availability and is not responsible for any costs involved in any way whatsoever including and not limited to travel costs, accommodation costs  etc, should the caravan be unavailable. 

b.       The company reserves the right to alter or change specifications and or prices at any time and to refuse or cancel a booking at any time without giving a reason.

11      Liability.

a.       The company shall bear no liability in respect of damage by the company to the customer’s property in respect of which the customer shall claim against their insurers. Subject as expressly provided in these conditions, all warranties, conditions, or other terms implied by statue or common law are excluded to the fullest extent permitted by law except in respect of death or personal injury caused by the companies negligence and save as otherwise set out in these conditions, the company shall not be liable the customer by reason or any  misrepresentation or any implied warranty , conditioner other item or any duty at common law or under the express terms of the contract or for any indirect, special or consequential loss or damage whether or not such a loss or damage was reasonable foreseeable (whether for loss or profit or otherwise) costs, expenses or other claims of compensation whatsoever (and whether caused by negligence of the company or its employees subcontractors or otherwise) which arises out of or in connection with the supply of goods and or services or in the case of goods their use or resale by the customer and the entire liability of the company under or in connection with the contract shall not exceed the price of the goods or services as appropriate or the amount of cover afforded by the companies insurance (which ever is the lower figure).

b.       The company shall not be liable to the customer for any delay in performance or any failure to perform any of its obligations under the contract if such delay or failure was due to cause beyond the companies reasonable control including but not limited to acts of God, strikes, lock outs, fire, adverse weather conditions, or the non return of the caravan to the company by the previous customer, etc.

c.       The company shall not be liable to the customer for any loss or damage arising from any representations, agreement, statements, or undertakings made prior to the contract other than those confirmed in writing by the company.

12   Definitions.

a.      The “customer” is the person who hires the caravan and equipment from the company.

b.       The company is “1st Caravan Hire Ltd”.

c.       The “caravan” is the caravan including all its equipment, inventory and extras hired by the customer.

d.       The “hire period” is the period of time that the company agrees to hire the caravan to the customer.

e.       A “booking” is the process of making a contract between the customer and the company.

13      Basis of Contract

a.       These conditions shall apply to each and every agreement for the supply of services and goods by the company and supersede any previous terms and conditions of the company and shall prevail over any other terms. No variations of these terms and conditions shall be binding upon the company unless agreed in writing. These terms and conditions as shown on the company web site are the latest.

b.       The customers order shall be deemed to be accepted by the company only if confirmed in writing by the company.
